It's decided: The CBD ban will not happen!
The upcoming ban on CBD products announced by the Department of Agriculture on April 25, 2023 on their website will not happen! At yesterday's meeting, Prime Minister Petr Fiala, Minister of Agriculture Zdeněk Nekula and Minister for Regional Development Ivan Bartoš agreed on this position. The national anti-drug coordinator Jindřich Vobořil and the Minister for Legislation Michal Šalomoun were also present among the participants.
A few days ago we informed you about the proposed CBD ban, which was prepared by SZPI (National Agricultural and Food Inspection) in cooperation with the Ministry of Agriculture. The aim of the upcoming ban was to prevent the sale of hemp foods and dietary supplements with CBD (such as CBD oils and drops, gummies, capsules...) in the Czech Republic. The proposal for a ban by SZPI was almost immediately covered in the media. Manufacturers, distributors, experts, but also many users of CBD products, of which there are around 900 in the Czech Republic, have defended themselves against it.
One hundred million sector CBD hemp sales and products made from it was suddenly in danger. Fortunately, Prime Minister Petr Fiala himself, Deputy Prime Minister Ivan Bartoš, and national anti-drug coordinator Jindřich Vobořil also joined the side of cannabis entrepreneurs and the public interest. The appointed political officials met with the Minister of Agriculture in this composition at yesterday's meeting.

CBD sale – prohibition NO, regulation YES
A working group of experts is now looking at a way to exempt dietary supplements and CBD foods from the 'novel' food regulation legislation. As part of these preparations, clear rules for physical and internet should be prepared at the same time CBD sale. Cannabidiol could be included in the list of so-called psychomodulating substances. The government would like to place, for example, on this list kratom, or hemp cannabinoid HHC aka hexahydrocannabinol.
The sale of cannabinoids from hemp and kratom would continue to be legal, but would be subject to strict regulation, which should apply in particular to the enforcement of customer age verification. This should include a ban on sales in vending machines where minors can buy it. There is no mention of mandatory placement of ID card reading devices on vending machines. As for the upcoming ban HHC, it is still not clear how it will all turn out. The Ministry of Health wants prohibition, the government wants regulation. We will also closely monitor this matter and will regularly inform you about all important events.
