Cannabis, kratom and legislation in Europe: Where to be careful?!
The rules and regulations regarding cannabis products and kratom in European countries may vary from state to state as each country has its own legislation and attitude towards cannabis products. Do you know these differences? When traveling out of a country, it is important to always check the current laws of the specific country you are going to before exporting cannabis products or kratom.
This article can be useful for you if you are planning to go on vacation and don't know what to take with you CBD, HHC or kratom, or leave your helpers at home to be safe. This article will tell you everything you need to know before traveling abroad.
Kratom
In some European countries it is indonesian kratom legal and can be bought and sold without restriction. In other countries, on the other hand, kratom is considered illegal and its possession or sale is prohibited. It also varies where kratom is legal but regulated as a medicinal product, meaning it must meet certain quality and safety standards.
Hemp products
Similar to kratom, the legal status of cannabis products can vary. In some places they are banned, in others they are regulated as part of a natural medicinal product, and in other countries their possession or use is considered illegal.
Cannabis and kratom vs country legislation in Europe
Please do not forget the fact that even if you are just passing through the country, its laws apply to you. We recommend checking the information before departure. The political scene is somewhat unpredictable and the laws can therefore change from day to day. In any case, do not distribute or sell cannabis or kratom abroad, only bring with you an amount for personal use.
Slovakia
We will start with our closest neighbors, Slovakia. In 2021, CBD was removed from the list of narcotic and psychotropic substances. This means that CBD products are legal, but under certain conditions, for hemp flowers it is a THC level of up to 0,2%. However, the products are not intended for direct consumption. In Slovakia, CBD is legislatively very similar to ours. Unfortunately, you cannot bring kratom and HHC into Slovakia, both substances are included in the list of prohibited substances.
Polsko
In Poland, the laws are a bit more pleasant. CBD with a THC content of up to 0,2% is fully legal and can also be sold as a dietary supplement. Kratom is a controlled substance in Poland and is illegal to purchase, possess and use. The same applies to HHC, which is included in the list of psychotropic substances.
Germany
In Germany, CBD is legal under the condition that the THC content is less than 0,2% and it must not be in the form of food. Germany is currently well on its way to legalizing marijuana. A bill has been introduced that would allow people over the age of eighteen to possess 30 grams of marijuana and grow up to three plants. Kratom is also fully legal for personal use in Germany, provided it is properly labeled. HHC in Germany is only legal if it is not synthetically produced. Since HHC is made by treating CBD flowers, most HHC products are legal in Germany.
Austria
If you are going on vacation to the Austrian Alps, it is completely legal to take CBD products with a THC content of up to 0,3%. However, they must not be advertised as dietary supplements or medicines. CBD is marketed as an aromatherapy product. It is also completely legal to use kratom for personal purposes. The Austrian Ministry of Health has placed HHC on the list of psychoactive substances and for this reason the production and trade of HHC is prohibited. However, possession and consumption of this substance is not a crime.
Italy
Some CBD oils are available on prescription in Italy. However, all other CBD products are fully legal as long as they contain less than 0,6% THC. Kratom is a banned substance in Italy. Sale, import and export is illegal. In Italy, HHC is intended for research and industrial use only. Similar to the Czech Republic.
France
In France, CBD is legal if it contains 0% THC. But beware of CBD oils – they are only legal in France if they are made from seeds and fibres, not leaves and flowers. The use and possession of kratom is also legal, but selling it is a crime. French legislation has recently placed HHC on the list of banned substances. Therefore, definitely do not transport hexahydrocannabinol to France.
Switzerland
In Switzerland there are no restrictions for cannabidiol CBD, the legal THC limit is set at 1%, just like in the Czech Republic. Especially watch out for HHC and kratom, these commodities are illegal in the Alpine country.
Spain
It is prohibited to sell CBD as a consumable. CBD can be sold as a cosmetic if the product is labeled as a technical product or for external use only. The product must also contain less than 0,2% THC. The same rules apply to HHC in Spain as in Italy, that is, it is not intended for direct consumption or smoking. It is therefore most often a collector's item. Buying, selling and using kratom is legal in Spain.
Portugal
In Portugal, CBD is only legal with a doctor's prescription. The same laws apply to HHC here as in Italy and Spain. On the contrary, kratom is legal here, so you can consume it as you like, but it must be used only for personal use.
Slovenia
With an upper limit of 0,2% THC, CBD is legal in Slovenia. Kratom, on the other hand, has been illegal since 2019. HHC is not yet regulated in any way, therefore the same legislation applies here as for the Czech Republic.
Hungary
Hungary is another country with legal CBD products with an upper limit of 0,2% THC. Kratom is fully legal here. HHC products they are also not regulated in any way, so you can count on the same rules as with us.
Croatia
For CBD, the same applies to Croatia, as long as you stay within 0,2% THC, you are safe. The same goes for kratom, there are no restrictions on personal use. As in the Czech Republic, HHC is also legal and the same conditions apply to it.
Netherlands
It's a win in Holland, you can legally use cannabis for recreational purposes and the same goes for CBD, HHC and kratom. However, definitely do not transport anything across the border, you could get yourself into trouble.
Greece
The popular holiday destination has similar CBD laws to the rest of Europe, up to 0,2% THC. Kratom is also fully legal here.
