Regulation of CBD, HHC and Kratom - What will change in 2024?

Recently, the Czech Republic has been experiencing dynamic development in the field of alternative remedies. CBD a HHC products, equally kratom, are known for their varied effects on the human organism. That is why they have become the focus of attention of politicians and regulatory authorities. What will the upcoming government regulation of these substances bring in the new year?

Questions about their legality, regulation and availability leave the medical community, vendors and the public in suspense. What is the current situation of these substances in the Czech Republic and what are the steps towards future regulation? Let's take a closer look at the current state and possible scenarios for the development of this issue.

What about CBD, a substance with proven therapeutic effects?

After decades of society's dismissive attitude towards this medicinal and truly versatile herb, fortunately everything is returning to its roots - i.e. the use of hemp in the food, textile and cosmetic industries, and especially in folk medicine. Even today, there are many people who abuse cannabis as a drug, however, the current trend is to look for the positive aspects of cannabis, of which there are certainly not a few.

It came to the fore especially in medicine. CBD oils they are a big hit among food supplements, and anyone who doesn't use CBD is as if they didn't even exist. That is why the effects of this substance have been studied in countless studies, which have already confirmed some of the positive effects of cannabidiol. Even CBD has become part of drugs that suppress the manifestations of epilepsy. However, the medical potential of cannabidiol is much greater, and thus the value of the "CBD industry" is skyrocketing.

And what is the situation with cannabidiol and cannabis in general from the point of view of legislation? The laws of the Czech Republic state as follows - only varieties containing less than 0,3% THC may be grown, and the law refers to these as technical cannabis. From 2022, this limit was raised to 1% THC. But what we are most interested in is CBD. The Ministry of Agriculture and Health alternately comment on the nature CBD as medicine, food or new food. Legislation still classifies this substance as souvenirs, but the discussion about the change is developing intensively.

The State Agricultural Inspectorate has increased its oversight of sellers of CBD products. However, they themselves do not show negative effects and are not such an imaginary "thorn in the side". The problem lies in the classification of CBD as a novel food by the Ministry of Agriculture, which is controversial given its history in the EU.

The Czech hemp cluster called on the Ministry of Agriculture to discuss the classification of CBD as a traditional food. CBD users are on the rise, with nearly 459 individuals using the substance in 2021. Regulation would protect consumers and enable innovation for farmers, but the debate over CBD's inclusion and possible regulation is still ongoing.

Currently, we can state that cannabidiol is legal and over the counter. However, it is not officially approved either as a food or as a medicine.

HHC and legislation - will the sale of HHC be regulated?

Unlike CBD, the regulation of HHC (a semi-synthetic cannabinoid with similar properties to THC) has become a hot topic for Czech legislators. Minister Vlastimil Válek proposed a tough procedure in the form of a complete ban of HHC and other similar substances due to the dynamic development of sales in the gray zone via the Internet and vending machines.

However, this proposal met with resistance right away at the cabinet meeting. Pirate party she was one of the main opponents of strict prohibition and argued against "prohibition", advocating regulation over prohibition. As a result, HHC is likely to remain off the list of banned substances, but with stricter regulation aimed mainly at protecting young users. The proposed restriction is stricter than in the case of alcohol or drugs. The parliamentary proposal lying in the House of Representatives seeks to ban sales to minors and limit the distribution of HHC in vending machines and on the Internet, if e-shops cannot adequately prevent sales to minors.

Kratom as the most discussed substance today

The discussion about the regulation of kratom in the Czech Republic is gaining intensity due to concerns about its possible abuse and health effects. The proposals and reasons are similar to those mentioned above HHC. The proposed changes in regulation should aim to limit the sale of this plant, which has psychoactive effects. What specific changes are involved?

• No sale to minors – the Ministry of Health proposes that kratom sales was restricted to persons under 18 years of age. This measure would also include sales in vending machines near schools and in shopping centers.
• Restrictions on online and vending sales - regulation of the sale of kratom on the Internet and in vending machines is discussed to minimize easy access to the substance by young people.

These moves are in response to concerns about the negative effects of kratom use in larger doses and the potential for addiction. The World Health Organization has opposed a global ban on kratom and emphasizes that in this case properly set regulatory measures will suffice. Different countries have different legal status of kratom. In the Czech Republic, kratom is currently legal for collector purposes, but the ongoing discussion focuses on how best to limit its availability in order to minimize potential health risks and addiction among young people.

Regulation of CBD, HHC and kratom in conclusion

The Czech Republic is intensively discussing the regulation of substances such as CBD, HHC and kratom. CBD remains in an uncertain state, while HHC faces tighter regulation instead of a hard ban. However, kratom has received the most attention, with proposed measures aimed at limiting sales, particularly to young people, in response to concerns about potential abuse and health risks. The state is thus trying to find a balance between the availability of these substances and the protection of public health.
