Cannabis legalization in Germany is one step closer! What is changing?

We wanted other countries to be inspired by us. Instead, our government approved the ban on HHC and THC-P, while in Germany the situation is exactly the opposite. Cultivation of cannabis with THC content will be allowed here, and the amendment will also bring a number of other interesting changes.

Finalization is underway in the current weeks the long-debated changes to the cannabis law. The German government has been discussing some legalization of marijuana for recreational purposes since autumn 2022. It is a complicated process, as the legalization must be in accordance with international and European law. The so-called United Nations Convention on Narcotic Drugs from 1961 also applies to Germany. And the Schengen Convention must also be taken into account.

Legalization of possession a cultivation cannabis approved!

A bill was introduced in April 2023 after the coalition government of Germany came to a unified opinion on the rules and regulations of the use of cannabis. The so-called the hemp law was passed 16. August 2023 and starting with April 2024, XNUMX should start with our western neighbors legalization of possession and cultivation of marijuana. Subsequently, you can from On July 1, expect the creation of so-called clubs for the common cannabis cultivation. 

Compared to the original intention, the new rules regarding both possession and consumption of cannabis should be less strict. Government officials said that permitted amount of dried cannabis held in private by a person over the age of 18 should be increased from the previously valid 25 grams to 50 g. The criminal liability of cannabis holders is also changing. A quantity of 25-30 grams held in public spaces will be newly dealt with as an administrative offence, as well as 50 to 60 grams held in private. Possession of an amount in excess of the specified limit will then be classified as a criminal offence. 

What else will the new marijuana law bring?

Next, there will be reduction of fines. Until now, the maximum possible fine for possession of cannabis was EUR 100, now the maximum should be EUR 000. It should also be added that reduces the zone completely excluding the consumption of cannabis in the vicinity of schools, kindergartens and playgrounds from the original 200 meters to 100.

At the moment it is not yet clear what they will be penalties for driving motor vehicles under the influence of cannabis consumption. The German Ministry of Transport should make a decision by the end of March 2024. While driving under these circumstances has been completely prohibited until now, a new rule specifying the permitted limit should come into force with the new law THC in the blood.

So, apparently, the countdown begins for the last few weeks, when laws very similar to ours apply in Germany. marijuana it is there just like here legal for medical purposes only (as of 2017). Apparently, however, doctors do not prescribe it much, and sources say that only a few hundred patients are treated in this way. 

Who expected from of the new German law essentially a free market for marijuana, he should know that certain strict rules will continue to apply. For example, any advertising of cannabis is not allowed, sales will be possible exclusively through grower associations, and only to their members. Distance sales, i.e. including the online cannabis business, are also prohibited. In addition, everything refers to pure cannabis, not semi-synthetic cannabinoids (e.g. HHC or H4CBD) or various combined products.

Less cannabis on the black market and less crime!

The German Minister of Health hopes to take this step a decline in cannabis sales on the black market and reducing the number of cases of criminal liability for possession of cannabis. Germany has been dealing with the increase in drug-related crime for many years. According to available sources, hemp contributes up to 50%, so a noticeable decrease could be recorded here.
